This Membership Agreement (the “Agreement”) is concluded between Shofic, an online provider of digital social-media visibility services operating from Dubai, United Arab Emirates (the “Provider” or “Shofic”), and the natural or legal person who creates an account on shofic.com (the “Member”). “Site” means shofic.com and its subpages; “Services” means the social-media visibility and engagement services offered on the Site; “Account” means the personal member area accessed with the Member’s credentials; “Balance” means prepaid funds credited to the Account for future orders.
By completing registration, the Member confirms that they are at least 18 years old or have the consent of a legal guardian, and that they accept this Agreement together with the Terms & Conditions, the Privacy Policy and the Refund Policy published on the Site.
This Agreement governs the creation and use of a member Account: registration, login, the member dashboard, order history, Balance management, and the rights and obligations of both parties in connection with the Account. The purchase of individual Services is additionally governed by the Distance Sales Agreement presented at checkout; where this Agreement and the Distance Sales Agreement conflict regarding a specific order, the Distance Sales Agreement prevails for that order.
To create an Account, the Member provides a valid email address and chooses a password. The Member undertakes that all information provided at registration and afterwards is accurate, current and belongs to them, and that they will update it without delay when it changes. Shofic may refuse or cancel registrations made with false, misleading or third-party information. One person may not operate multiple Accounts for the purpose of abusing promotions, guarantees or refund rules.
Membership is optional. Shofic supports guest checkout: Services can be purchased without creating an Account, using only an email address and the public link or username to be promoted. Guest purchases are governed by the Terms & Conditions and the Distance Sales Agreement, but not by the Account-specific provisions of this Agreement. Membership adds convenience features — saved order history, faster reordering and a prepaid Balance — without changing the nature, pricing or guarantees of the Services themselves.
The Member undertakes to use the Account and the Services lawfully and in accordance with the rules of the third-party platforms concerned. In particular, the Member shall: submit only accounts, posts or videos that they own or are authorized to promote; keep the target account public for the duration of delivery; provide correct links and usernames; refrain from ordering services for content that is illegal, hateful, or infringes the rights of others; and refrain from any attempt to disrupt, reverse-engineer or gain unauthorized access to the Site. The Member bears sole responsibility for the content they choose to promote.
The Member is responsible for keeping their Shofic password confidential and for all activity carried out through their Account. Choose a strong, unique password and do not reuse credentials from other sites. Actions performed after a successful login are deemed performed by the Member unless the Member proves otherwise. If the Member suspects that their credentials have been compromised, they must change the password immediately and notify Shofic at info@shofic.com; Shofic will then take reasonable protective steps, such as temporarily locking the Account.
For clarity: this section concerns the Member’s Shofic password only. Shofic never asks for, and the Member must never share, the passwords of their social-media accounts — deliveries are made to public links without login access.
The member dashboard shows the Member’s orders, their status and, where applicable, remaining guarantee periods. The Member may add funds to their Balance using the payment methods supported on the Site — encrypted card payments, bank transfer and cryptocurrencies — and spend the Balance on Services. The Balance is a prepayment, not a deposit account: it bears no interest and may not be transferred to other users. Unused Balance is refundable upon an account-closure request, to the original payment method where technically possible, minus any non-recoverable payment-provider fees. Promotional or bonus credits, if any, are non-refundable and expire as stated at the time they are granted.
Shofic sends transactional messages — order confirmations, delivery updates, security notices and replies to support requests — to the email address on the Account; these messages are part of performing the service and cannot be opted out of while the Account is active. Marketing communications, such as newsletters or promotions, are sent only with the Member’s separate consent, which may be withdrawn at any time via the unsubscribe link in each message or by contacting support. Withdrawal of marketing consent does not affect transactional messages or the validity of this Agreement.
Shofic may suspend or, in serious or repeated cases, terminate an Account where there are reasonable grounds to believe the Member has: engaged in fraud or payment abuse, including unjustified chargebacks; violated this Agreement or the Terms & Conditions; used the Services against content they have no right to promote; or attempted to compromise the security of the Site. Where practicable, Shofic will notify the Member of the reason and give an opportunity to respond before termination. Suspension does not remove the Member’s right to a refund of undelivered orders and unused Balance, except for amounts subject to a fraud investigation or lawful set-off.
The Member may terminate this Agreement at any time by requesting account closure via the dashboard or support. Closure requests are completed within seven (7) business days; personal data is then handled as described in the Privacy Policy and the personal-data notice.
Shofic performs its obligations with professional care but does not control third-party platforms. Shofic is not liable for platform-side changes, algorithm updates, content removal or account measures taken by those platforms, nor for outcomes that depend on factors outside the Services as described on the Site. Except in cases of intent or gross negligence, and except where mandatory consumer law provides otherwise, Shofic’s total liability towards a Member for any order is limited to the amount paid for that order. Nothing in this Agreement excludes liability that cannot be excluded under applicable law.
Shofic may amend this Agreement for legitimate reasons such as changes in law, payment methods or features of the member area. The current version is always published on the Site with its last-updated date, and material changes are announced on the Site or by email. If the Member does not accept an amendment, they may close their Account before the amendment takes effect; continued use afterwards constitutes acceptance.
This Agreement is governed by the laws of the United Arab Emirates. Disputes arising from or in connection with this Agreement are subject to the jurisdiction of the courts of Dubai, UAE, without prejudice to any mandatory consumer-protection rules of the Member’s country of residence that grant the Member the right to bring proceedings before their local courts or consumer authorities. If any provision of this Agreement is held invalid, the remaining provisions remain in force.
